Code License

Last updated

1. What this covers

This Code License is an agreement between you and Swifolio (“Swifolio”, “we”) and is part of our Terms of Service. It sets out what you may do with:

  • “Licensed Code”: the source code of any design in the Swifolio library, however you get it: the code tab, a .zip download, copying, or an AI tool through the Swifolio MCP, along with any modified versions of it and anything derived from it.
  • “End Product”: an app, website, game, widget or other software product that you or your client make, in which Licensed Code is incorporated, together with substantial original work of your own, into something whose value isn’t just the Licensed Code itself.

Swifolio and its licensors own the Licensed Code and keep all rights in it. You receive a license, not ownership. Everything not expressly granted here is reserved.

Each copy of Licensed Code we deliver is marked as licensed to your account, with a license header and other marks that identify the copy, as Section 5 of the Terms describes. The marks don’t change how the code compiles or runs. You may leave them in your End Products, or delete the header comment from code inside your own End Products.

2. The Pro license

While your Pro subscription is active, and subject to this license, we grant you a worldwide, non-exclusive, non-transferable, non-sublicensable license to use, copy, modify and adapt Licensed Code to create End Products, and to distribute and sell those End Products in compiled or other end-user form. You may:

  • use Licensed Code in an unlimited number of End Products, personal or commercial, free or paid, on any platform;
  • modify it, combine it with other code, and translate it to other languages or frameworks for your End Products;
  • use it in client work: build End Products for clients and hand over the finished End Product, including its source, for the client to own, run and maintain. The client may maintain and modify that End Product, but gets no right to use the Licensed Code separately from it;
  • let your colleagues and contractors work on End Products that contain Licensed Code you added (see Section 5 on accessing the library itself);
  • ship End Products without crediting Swifolio. No attribution is required, though it’s always appreciated.

3. Code you keep forever

The license for Licensed Code you downloaded, copied or fetched while your subscription was active is perpetual: it continues after your subscription ends, for any End Product, including new ones you start later. End Products you shipped or delivered to clients stay licensed too. After your subscription ends, you can’t download or fetch new Licensed Code, or code you didn’t already have, until you subscribe again.

This perpetual license still depends on you following this license. It ends if we terminate it for a breach under Section 9; End Products that you lawfully distributed to end users before then can stay with those users.

4. What you may not do

You may not, and may not allow anyone else to:

  • Redistribute the code as code. Sell, give away, publish or share Licensed Code, on its own or modified, as source code or in any other form that lets others reuse it as code, including as or in templates, UI kits, component libraries, design systems, starter projects, boilerplates, code snippets, tutorials or courses, Swift packages, marketplaces (such as Gumroad, CodeCanyon or the Unity Asset Store) or public repositories. The narrow exception for open-source End Products is in Section 6.
  • Sublicense, rent, lend or transfer this license or Licensed Code, except as part of an End Product handed to a client under Section 2.
  • Share access. Share your account, sign-in, downloads, .zip files, API keys or MCP connections, or let anyone else use the library through them.
  • Compete with us. Use Licensed Code, our recordings or our catalogue to make or contribute to a product or service whose purpose is offering SwiftUI or other UI designs, components, templates or code to others, including a competing library, a code generator seeded with our code, or an MCP or API that serves it.
  • Train AI on it. Collect Licensed Code or other library content, in bulk or systematically, into a dataset, or use it to train, fine-tune, evaluate or benchmark a machine-learning model, or let others do so. An AI assistant reading code while helping you build your own End Product, through the MCP or by pasting, is allowed.
  • Bulk-download or scrape the library by any means, including scripts, bots, scrapers, headless browsers or bulk calls to the MCP or API, or keep a mirror or archive of it beyond the designs you actually use in End Products. Downloads have fair-use limits, described in the Terms.
  • Remove the marks. Remove, alter or obscure the license header or other marks that identify the account a copy was licensed to, in order to hide where it came from.
  • Mass-produce reskins. Ship many near-identical End Products that are little more than Licensed Code with changed names, colours or content, or sell such apps as resellable “app templates”.
  • Claim it as your own. Present Licensed Code itself as your original work for sale, or file copyright or patent claims over it. (Your End Products, and your own additions, are yours.)

5. Individuals and teams

A Pro subscription licenses one person. Everyone who opens the library’s code, downloads designs or uses the MCP needs their own subscription. Teammates who only work on an End Product’s codebase, and don’t access the library, don’t. If you subscribe for a company, the license is for the named subscriber’s use on behalf of that company. For team or enterprise licensing, email [email protected].

6. Open-source End Products

You may publish the source of an End Product, such as an open-source app, only if: the Licensed Code is part of a substantially larger app; it isn’t separated out into a reusable component, package or folder offered for reuse; and the repository states that files derived from Swifolio aren’t covered by the project’s open-source license and may not be reused outside that app. You may not put Licensed Code under an open-source or any other license yourself. When in doubt, keep it in a private repository.

7. Free designs, previews and recordings

  • Free designs. If a design is marked free, you may use its code under this license as if you were a Pro subscriber, for as long as you have it, with all the same restrictions.
  • Previews. Without Pro, you may browse designs, recordings, posters and descriptions for personal reference and inspiration. You may not download, re-host, scrape or republish them, use them in your own marketing, or use them to recreate locked code line by line.
  • Inspiration is free. Seeing a design and building your own, independent version of the idea is fine. Copying our code or recordings isn’t.

8. Code from the MCP and AI tools

Code an AI tool fetches through the Swifolio MCP is Licensed Code. Code that an AI tool writes by adapting, translating or combining Licensed Code is derived from it and is covered by this license in the same way; you may use it in your End Products. Code an AI tool writes that contains nothing from Swifolio is not ours, and we claim nothing in it. We don’t guarantee anything an AI tool produces. Check, test and review it before you ship.

9. Termination

If you breach this license, it ends automatically for all Licensed Code, including code covered by Section 3. We may also suspend or end your account under the Terms, immediately and without a refund for scraping, automated access, account sharing or redistribution. On termination you must stop using Licensed Code in new work and delete copies you hold outside End Products already distributed to end users before the breach, unless we agree otherwise in writing. We may enforce our rights in court, including by injunction, as the Terms allow; a breach of this license may also be copyright infringement.

Agreed damages. If you redistribute, sublicense or make available Licensed Code in breach of this license, you agree to pay the greater of our actual damages or US$500 for each design redistributed, sublicensed or made available, as liquidated damages. This is a reasonable pre-estimate of a loss that is hard to measure in advance (lost subscription revenue, the cost of finding and removing copies and enforcing our rights, and the harm to Pro’s exclusivity), not a penalty. The prevailing party in a dispute over a breach of this license may recover its reasonable attorneys’ fees and costs. The details are in Section 5 of the Terms.

10. Third-party materials keep their own terms

This license only covers Swifolio’s own code. Other material that appears in or alongside designs has its own terms:

  • Stock photos and videos in recordings, previews and demo projects come from Pixabay and Pexels under the Pixabay Content License and the Pexels License. They are placeholders: .zip downloads contain Swift source only, so supply your own images or get them under their licenses yourself. Don’t imply that anyone pictured endorses your app.
  • Fonts shown in designs or on the site are under their own licenses, many under the SIL Open Font License 1.1; Apple’s system fonts are under Apple’s terms.
  • Sample content, songs and sounds used in demos are placeholders and aren’t licensed to you. Replace them with content you own or have licensed.
  • Open-source code. If a design includes or depends on open-source code, that code stays under its own license (for example MIT or Apache 2.0), and you must follow that license, including keeping its notices.
  • Apple frameworks and SF Symbols are under Apple’s license agreements, which, for example, restrict SF Symbols to apps on Apple platforms and forbid using them in logos or trademarks.
  • Other brands. Designs “inspired by” other apps don’t license their names, logos, icons, artwork or trade dress. This license grants no trademark rights. Before shipping, replace anything that identifies another brand and make the design your own; App Store Review Guidelines 4.1 and 5.2 reject copycat apps and apps that use others’ IP. See our Copyright & DMCA Policy.

11. No warranty and limited liability

LICENSED CODE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WITH NO PROMISE THAT IT WILL PASS APP REVIEW, WORK ON EVERY OS VERSION OR DEVICE, OR BE FREE OF BUGS OR SECURITY ISSUES.

You are responsible for reviewing, testing and securing Licensed Code in your End Products. The disclaimers, limitation of liability and indemnity in Sections 10 to 12 of the Terms of Service apply to this license.

12. Everything else

We may update this license for future downloads; code you already have stays under the version that applied when you got it, unless you agree otherwise. Disputes about this license are handled under the Terms’ dispute section, which lets either of us go to court over misuse of intellectual property. Questions about whether a use is allowed: [email protected]. We’re happy to say yes in writing to uses this page doesn’t cover.
