1. About our designs

Swifolio’s designs are original SwiftUI code. Many are recreations “inspired by” well-known apps, made for education and inspiration: to show how an interface or interaction can be built in SwiftUI. They are not affiliated with, endorsed by or sponsored by Apple Inc. or by any company, app or brand they reference or resemble. App and brand names appear only to describe what inspired a design. All trademarks, logos and trade dress belong to their respective owners.

We respect intellectual property and expect our members to do the same: the Code License grants no rights in anyone else’s brand, and members must make designs their own before shipping. If you own a brand and want a reference or a design changed or removed, tell us; we’ll look at it quickly and in good faith.

2. Reporting copyright infringement (DMCA notice)

We respond to notices of alleged copyright infringement under the US Digital Millennium Copyright Act (17 U.S.C. §512). To be effective, your notice must be in writing, sent to our designated agent (Section 5), and include:

  1. your physical or electronic signature, as the copyright owner or someone authorised to act for them;
  2. identification of the copyrighted work you say is infringed (or, for several works, a representative list);
  3. identification of the material you say is infringing, with enough detail for us to find it, ideally the URL of each design or page;
  4. your name, mailing address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use isn’t authorised by the copyright owner, its agent or the law;
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act on the owner’s behalf.

When we receive a valid notice, we will remove or disable access to the material, make a reasonable effort to tell the member concerned, and forward them your notice. Under 17 U.S.C. §512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages, so please consider fair use and other defences before sending one.

3. Counter-notices

If material you provided was removed and you believe it was a mistake or misidentification, you may send our designated agent a counter-notice that includes:

  1. your physical or electronic signature;
  2. identification of the material removed and where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. your name, address and telephone number;
  5. a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if you are outside the US, any judicial district in which Swifolio may be found), and that you will accept service of process from the person who sent the original notice or their agent.

If we receive a valid counter-notice, we will send a copy to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we may restore the material within 10 to 14 business days after receiving the counter-notice.

4. Repeat infringers

We terminate, in appropriate circumstances, the accounts of members who are repeat infringers. We may also limit access or close accounts of anyone who infringes others’ intellectual property, whether or not they are repeat infringers, at our discretion.

5. Designated agent

Send DMCA notices and counter-notices to our designated copyright agent:

Copyright Agent, Swifolio
the mailing address we provide on request
Email: [email protected]
Phone: available on request

Please use the subject “DMCA notice” or “DMCA counter-notice”. The agent only handles copyright matters; other questions go to [email protected].

6. Trademarks and other rights

For trademark, trade dress or other concerns that aren’t copyright, email [email protected] with your contact details, the mark or right concerned, where it appears on Swifolio, and what you’d like us to do. Notices from outside the US are welcome too; we handle them in the same spirit.

Apple, iPhone, iPad, Mac, Apple Watch, Apple Vision Pro, Swift, SwiftUI, Xcode, SF Symbols and App Store are trademarks of Apple Inc., registered in the U.S. and other countries. Other product and company names mentioned on Swifolio may be trademarks of their respective owners.
